By accessing or using Recabulary you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the site. If you use Recabulary on behalf of someone else, you represent that you are authorised to bind that person to these Terms. Throughout this document "I" and "me" refer to the individual operator of Recabulary; "you" refers to the user.
You must be at least 13 years old (or the minimum digital-consent age applicable in your jurisdiction, whichever is higher) to use Recabulary. By using the site you confirm you meet this requirement. The site is not directed at children below this age.
Recabulary is provided strictly on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, or that the service will be uninterrupted, error-free, secure, or free of harmful components.
I make no promise that:
I may modify, suspend, or discontinue any part of Recabulary, including the entire site, at any time without notice and without liability to you.
To the fullest extent permitted by applicable law, in no event will I be liable to you or to any third party for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation damages for lost profits, lost data, loss of goodwill, business interruption, exam or assessment outcomes, personal or professional decisions made in reliance on the site, or any other intangible losses arising out of or in connection with your use of, or inability to use, Recabulary, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not I have been advised of the possibility of such damages.
My aggregate liability to you for all claims arising out of or relating to Recabulary or these Terms is limited to the greater of (a) zero (the site is provided to you free of charge), or (b) the smallest amount required to make this clause enforceable under applicable law.
Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties; in those jurisdictions the above limitations apply to the maximum extent permitted by law and the remaining provisions remain in full force.
Information on Recabulary, including word definitions, examples, AI-generated content, and any educational material, is provided for general interest only and is not professional, academic, legal, medical, or financial advice. Do not rely on Recabulary for examinations, publications, professional work, or any decision where accuracy matters; verify against authoritative sources.
You agree not to:
Authentication is handled by a third-party identity provider (Auth0). You are responsible for maintaining the confidentiality of any credentials you use to log in, and for all activity that occurs under your account. You agree to notify me promptly of any unauthorised use you become aware of.
I may suspend, restrict, or delete any account, and remove or refuse to display any user content, at any time and for any reason or no reason, without notice and without liability. You may delete your own account at any time by contacting me at the address below.
"Your Content" means any data you submit to Recabulary — for example, words you bookmark, terms you save, notes you attach, or starter-pack selections. As between you and me, you retain ownership of Your Content. You grant me a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, and process Your Content solely for the purpose of operating Recabulary for you. This licence ends when you delete the relevant content or your account, except for backups already taken and copies retained as required by law.
You represent that you have the right to submit Your Content and that it does not infringe any third-party rights or violate any law.
The Recabulary name, logo, design, and source code are owned by me. Definitions and word data may be sourced from public dictionaries, AI models, and other third parties, and are subject to those parties' rights and licences. Nothing in these Terms grants you any licence in my marks or branding beyond ordinary, accurate descriptive reference.
Recabulary uses third-party services to operate, including (without limitation) Auth0 for authentication, Microsoft Azure Static Web Apps for hosting, Google Firebase / equivalent cloud services for backend functions, and AI / dictionary providers for word information. Your use of those underlying services is subject to those providers' own terms and privacy policies. I am not responsible for any act, omission, outage, data handling, or content of any third-party provider.
Recabulary is currently offered free of charge. I have no obligation to keep it free, to maintain feature parity over time, to migrate or export your data, or to give advance notice before changes. If pricing is ever introduced, it will only apply to use after the change.
You agree to defend, indemnify, and hold harmless me, my heirs, and any individuals helping me operate Recabulary from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the site, (b) Your Content, (c) your breach of these Terms, or (d) your violation of any law or third-party right.
I may update these Terms from time to time. The "Effective date" at the top reflects the latest version. Changes take effect when posted. Your continued use of Recabulary after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, stop using the site.
These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of Recabulary will be subject to the exclusive jurisdiction of the competent courts located in India. If you are a consumer in a jurisdiction whose law grants you mandatory rights that cannot be waived, those rights are not affected by this clause.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding Recabulary and supersede any prior understandings.
My failure to enforce any right or provision will not be a waiver of that right or provision. You may not assign or transfer these Terms, by operation of law or otherwise, without my prior written consent. I may freely assign these Terms.
